Teacher convicted of sex abuse to remain in jail

A former Howard County teacher sentenced to four years in prison for undressing and photographing a 16-year-old male student will not be released while he appeals his conviction.

Alan Beier, 54, said he has been subjected to “inhumane” conditions and had been beaten by other inmates.

Beier claimed news coverage caused some inmates at the Baltimore City Correctional Center to beat him last month. He was treated at a local hospital for a broken nose and facial cuts.

Beier’s lawyer said Thursday in Howard County Circuit Court that the prisoner was then transferred to the Metropolitan Transition Center in Baltimore. There, he was held in a 24-hour segregation cell with no windows, blankets or showers for three days.

Lawyer Robert Woods said segregation was “horrific.” He added that Beier was not safe in the general population, because inmates misinterpret the child sex abuse conviction to mean Beier is a “child molester” and “pervert.”

“It’s almost nonsensical to think this is not going to happen again. … Every time he’s mentioned in the press, he’s going to be beaten and attacked,” Woods said.

Beier is being held at the Jessup Transition Center; he has not suffered any physical attacks there.

Beier was convicted in March of second-degree assault and sexual abuse of a minor. Prosecutors say Beier took nude photos of the boy in his science classroom at River Hill High School in Clarksville.

Woods said the boy suffered no physical injuries and graduated from high school; Beier, he said, has lost everything.

But Judge Diane Leasure refused to release Beier on bail or home detention while he appeals his conviction. The violence described was “deplorable,” she said, but the correctional facility, not the judge, should be responsible for the welfare of the inmates.

“Jail is probably not a place anybody wants to spend a lot of time,” the judge said.

Beier began to cry at the judge’s decision. As he left the court, Beier shouted that he would end up dead.

Beier has been accused of sexually abusing another boy by taking photographs of him as a promotion for the Mr. River Hill High School Contest in April 2006. And a 17-year-old female student claims Beier fondled her. Those cases have not come to trial.
